I. POSITION OBJECTIVE
Responsible for independently building, operating and comprehensively supervising the Company's compliance management function, ensuring the Company and the entire system fully comply with legal regulations, State Bank regulations and internal regulations; promptly identifying, warning and promoting remediation of compliance risks and violations.
II. MAIN RESPONSIBILITIES
1. Compliance Register (Compliance Risk Register Management)
- Build, manage and periodically update the Compliance Risk Register across the Company.
- Identify, classify and assess the level, likelihood and impact of compliance risks.
- Periodically review and update the compliance risk register according to changes in laws, regulations of regulatory agencies and the Company's business activities.
- Monitor material compliance risks and propose appropriate control and mitigation measures.
2. Regulatory Obligations Management
- Monitor, update and fully and timely manage legal documents and regulations of the State Bank and relevant regulatory agencies related to the Company's operations.
- Assess the impact of new or changed regulations on the Company's products, processes, business activities and control systems.
- Identify, allocate and notify compliance obligations to responsible units; monitor and follow up on implementation progress.
- Consolidate and alert compliance obligations with deadlines or material impact levels.
3. Compliance Monitoring
- Conduct regular monitoring of compliance with laws, internal regulations and regulatory agency requirements at business units.
- Build and operate compliance monitoring indicators, tools and dashboards to support continuous monitoring and identify risk trends.
- Analyze monitoring results, identify abnormal signs and emerging compliance risks.
- Implement early warning to competent authorities regarding issues, violations or compliance risks that may affect the Company.
4. Compliance Testing
- Develop periodic/ad-hoc compliance testing plans using a Risk-Based Approach.
- Organize and/or coordinate compliance testing for units, products, processes and business activities.
- Assess the level of compliance, identify causes and impacts of findings/violations.
- Prepare testing result reports and propose measures to improve processes and controls to prevent and minimize recurring risks.
5. Monitoring and Managing Violation Remediation
- Monitor and follow up on relevant units to fully and timely implement remediation measures for compliance findings and violations.
- Assess the completeness, appropriateness and effectiveness of remediation measures before recording completion.
- Monitor outstanding, overdue and recurring issues; promptly alert competent authorities.
- Periodically consolidate and report remediation status and material compliance issues.
- Report to the Board of Directors, Supervisory Board and/or Management Board on serious, prolonged or untimely remediated violations.
6. Other Responsibilities
- Build and implement training and communication programs to enhance compliance awareness and culture across the Company.
- Periodically review the appropriateness of the internal regulation and process system with laws and regulatory requirements; propose amendments and supplements when necessary.
- Coordinate with Legal & Advisory Department, AML/CFT Department, Internal Control, Internal Audit, Risk Management and relevant units in identifying, assessing and managing overall risks.
- Perform other tasks as assigned by competent authorities
III. JOB REQUIREMENTS
1. Qualifications and Experience
- University degree or higher in Law.
- Minimum 02 years of experience in compliance, internal control, internal audit or legal affairs at credit institutions/financial organizations.
2. Knowledge and Skills
- Understanding of legal regulations in credit institution operations, personal data protection regulations.
- Risk analysis and assessment skills; planning and organizing inspection and monitoring skills.
- Communication, presentation and report writing skills; ability to work independently and under high pressure.
- Proficient in office software; ability to exploit compliance monitoring tools/systems.
3. Professional Certifications (Preferred)
- Professional/operational certifications in compliance, related to risk management, internal control (if any) are preferred.
4. Personal Qualities
- Honest, objective, principled, independent in assessment and decision-making.
- High sense of responsibility, proactive, careful, information confidentiality.
